These Terms of Service govern your access to and use of the CreateOS platform and website. By using CreateOS, you agree to these terms.

1. Acceptance

By accessing or using CreateOS, you agree to be bound by these terms. If you are using CreateOS on behalf of an organization, you represent that you have authority to bind that organization.

2. The service

CreateOS provides a governed execution layer for running AI in production. Features and availability may change as the platform evolves. Specific commitments are set out in your order form or master agreement.

3. Accounts and access

You are responsible for the security of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to use CreateOS to violate any law, infringe the rights of others, or attempt to disrupt or gain unauthorized access to the service. We may suspend access for violations.

5. Customer data and ownership

You retain ownership of the data you submit and the outputs generated for you. We process your data only to provide the service, under the terms of your agreement and our Privacy Policy.

6. Confidentiality

Each party will protect the other's confidential information with reasonable care and use it only to perform under these terms.

7. Fees

Fees are set out in your order form. Unless stated otherwise, fees are non-refundable and exclusive of taxes.

8. Warranties and disclaimers

CreateOS is provided on an as-is and as-available basis. Except as expressly stated in a signed agreement, we disclaim all implied warranties to the extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential damages. Direct liability is limited as set out in your agreement.

10. Term and termination

These terms apply while you use CreateOS. Either party may terminate as set out in the applicable agreement. Provisions that by nature should survive termination will survive.

11. Governing law

These terms are governed by the laws specified in your agreement, without regard to conflict-of-laws principles.

12. Changes

We may update these terms. Material changes will be communicated, and continued use after changes take effect constitutes acceptance.
